The credit
reports may be shown or discussed with the applicant, but a copy
may not be given to the applicant.
Creditors must have a
valid credit reason to access a credit report:
- Court orders including federal grand jury
subpoenas
- With written permission of consumer
- Underwriting Insurance
- Government agency issuing a license or other
benefit (security clearance)
- Secondary or securities loan market operators
for evaluation of the quality of a loan portfolio
- Child Support
- Extension of credit
- Review or collection of an existing account
- Employment purposes
- Legitimate business need in connection with
a transaction initiated by the consumer including account review
and/or monitoring
If a credit report is accessed without a valid
reason a $2,500 per report fine, 2 year prison sentence and cancellation
of CIC membership may result.
If an applicant wishes to obtain a copy of his/her equifax
credit report, have them contact 800-685-1111 or give them
the name, address and telephone number of the bureau listed
at the top of the credit report so that the applicant may
contact that bureau directly.
Do Not Access Your Own Credit Report!!! If a personal
copy is desired, please contact one of the credit bureaus
for a personal copy.

Employment Purpose (PERSONA) requirements:
- Separate written disclosure in "clear and
conspicuous" language that consumer report will be requested must
be given to the consumer.
- Written consent from the consumer must be
obtained.
- The consumer must be provided a copy of his/her
consumer credit report before any adverse action is taken.
- Consumer must be given a copy of his/her
rights by law in the event of adverse action.
- Information may not be used in violation
of any applicable federal or state equal employment opportunity
laws or regulations.
Child Support requirements:
- The consumer credit report is used only to
determine child support payments.
- The paternity of the child has been established.
- The consumer whose report is being requested
must be notified ten days prior to submitting credit report request.
- Report will be kept confidential and used
only for child support purposes.
